- Liability for Damages: Give Aid aims to provide a reliable and secure platform; however, we cannot guarantee absolute immunity from technical glitches, unforeseen circumstances, or actions beyond our control. While we strive to maintain the utmost integrity, users acknowledge that the use of the app is at their own risk. Give Aid shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from normal app usage. However, in cases where it can be established that such damages directly result from proven negligence or misconduct on the part of Give Aid, our liability shall be limited to the extent permitted by law. This includes situations where issues arise from our own actions, errors, or failures, provided they are not caused by the user's misuse of the app or explicit violation of these terms.

- Third-Party Payment System: Give Aid utilizes Flutterwave as a third-party payment system for card donations within the app. Any issues arising from the use of Flutterwave's services are not the responsibility of Give Aid. Users agree that any disputes, problems, or concerns with Flutterwave's services will be addressed directly with Flutterwave.
- Modification or Termination of Services: Give Aid reserves the right to modify, suspend, or terminate app services or features. In the event of any significant modifications or terminations, reasonable notice will be provided to users via email, within the app, or through other appropriate means. We will endeavor to give users adequate prior notice of any such changes, except in cases of urgency, security concerns, or legal obligations where immediate action is necessary. In instances where account suspension or termination is under consideration due to violations of terms, fraudulent activities, or any behavior deemed harmful or inappropriate, users will be notified of the reasons and provided with an opportunity to present their case or clarify any misunderstanding. Users will have a specified period within which they can respond, providing relevant justifications or evidence to contest the proposed action against their account. The final decision regarding the suspension or termination of a user account will be made after considering any submissions made by the user. However, Give Aid reserves the right to take immediate action if there are compelling reasons, such as security threats or legal obligations, that necessitate prompt measures to safeguard the app and its users.
- Indemnification: Users agree to indemnify and hold Give Aid, its affiliates, employees, agents, and partners harmless from and against any claims, damages, liabilities, losses, costs, or expenses arising from their use of the app or any breach of these terms. However, this indemnification shall not apply to the extent that the claims, damages, liabilities, losses, costs, or expenses arise directly from proven negligence, willful misconduct, or material breaches of this agreement by Give Aid. In such cases, the indemnification obligation shall be limited to the maximum extent permitted by applicable law.
